Accounts and eligibility

You must be 18 years or older and legally able to enter into an agreement to create or manage an account. Parents or guardians manage participation and fundraising pages for children. Provide accurate information, keep account credentials secure, and notify us of unauthorized use. Organization representatives must have authority to act on behalf of their organization.

Fundraising campaigns

Organizers are responsible for the accuracy of campaign information, necessary permissions, lawful fundraising activities, and use of funds consistent with stated purposes. We provide fundraising services but do not guarantee a particular fundraising result. Any separately agreed campaign fees, service commitments, or payout terms remain governed by the applicable agreement.

Donations and payments

Payments are processed by Stripe and are subject to applicable payment terms. You must be authorized to use the payment method you provide. Review the campaign, amount, and any disclosed charges before submitting payment. Tax deductibility depends on the recipient and applicable law and is not guaranteed by us. Contact us promptly about payment errors, refunds, or disputes; eligibility depends on applicable law, campaign terms, and the circumstances of the transaction. Nothing in these Terms limits statutory consumer rights.

Communications

Email and SMS messages are sent via SendGrid and Twilio only with consent. Consent is not a condition of donating or purchasing services. Message frequency varies; message and data rates may apply. Unsubscribe using the email link, reply STOP to any message to opt out of SMS, or reply HELP for assistance. Contact support@givenextlevel.com for help. SMS Terms

GiveNextLevel Text Messaging is the text messaging program of Next Level Fundraising LLC (dba GiveNextLevel). Messages include account notifications, customer care, one-time verification codes, campaign updates, and follow-ups from Next Level Fundraising representatives.

You must be 18 years or older to use our services and to opt in to our text messaging program.

You can cancel the SMS service at any time. Just reply "STOP" to any message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@givenextlevel.com or (888) 448-3005.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Carriers are not liable for delayed or undelivered messages.

Acceptable use and content

Do not use the services for fraud, unlawful fundraising, harassment, infringement, unauthorized access, or interference with service security or availability. You retain ownership of content you submit and grant us permission to host, display, and process it as necessary to provide the services. You must have all required rights and permissions. We may remove unlawful or inappropriate content and suspend accounts where reasonably necessary to protect users or comply with law.

Intellectual property and third-party services

Our branding, website materials, and software are owned by us or our licensors. You may use them only as authorized in connection with the services. Third-party services and linked websites may have their own terms and privacy policies; we are not responsible for their independent practices.

Disclaimers and liability

To the extent permitted by law, the services are provided "as is" and "as available," without warranties of uninterrupted operation, error-free performance, or particular results. To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from use of the services. These limitations do not exclude liability that cannot legally be excluded, including fraud, willful misconduct, or applicable statutory protections.

Termination and changes

You may stop using the services at any time. We may suspend or terminate access for material violations, security risks, or legal requirements. Existing payment obligations and provisions that by their nature survive termination remain in effect. We may update these Terms by posting a revised effective date and providing notice of material changes as required by law.

California law

These Terms are governed by California law, without regard to conflict-of-law rules, except where applicable law requires otherwise. Disputes will be brought in courts with appropriate jurisdiction in California, subject to any non-waivable rights you have under applicable law. If a provision is unenforceable, the remaining provisions continue in effect.
